Refund policy

Overview

Thank you for shopping with antiquesandchic.shop.

We want customers to understand clearly how returns, refunds, replacements and claims are handled.

This Return and Refund Policy applies to purchases made directly through antiquesandchic.shop.

It operates in addition to, and does not replace, rights available under the Australian Consumer Law.

Consumer guarantees cannot be excluded by store policies. Where goods have a major problem, consumers may generally choose between a refund and replacement. Where a problem is minor, the seller is generally entitled to provide an appropriate remedy such as a free repair before a refund or replacement is required.

30-Day Voluntary Return Policy

In addition to statutory rights, antiquesandchic.shop offers eligible customers a 30-calendar-day voluntary return period for change-of-mind returns.

The 30-day period begins on the date the customer receives the relevant product.

To request a voluntary return, contact:

info@antiquesandchic.shop

within 30 calendar days after delivery.

This voluntary return period does not limit any longer or additional rights that may apply where a product is faulty, unsafe, damaged, not as described or otherwise fails to comply with Australian Consumer Law.

Change-of-Mind Returns

For a voluntary change-of-mind return to be accepted, the product should generally:

  • Be returned within 30 calendar days after delivery;
  • Be unused;
  • Be unworn where applicable;
  • Be unwashed where applicable;
  • Be undamaged;
  • Be in substantially the same condition in which it was received;
  • Include original accessories and components;
  • Include original packaging where reasonably possible; and
  • Be accompanied by reasonable proof of purchase.

Customers should contact us before sending a return so that appropriate return instructions can be provided.

Australian Consumer Law does not generally require a business to provide a refund solely because a customer changed their mind, found the item cheaper elsewhere or decided they no longer wanted it. A business that voluntarily offers a change-of-mind policy must follow that policy.

Change-of-Mind Return Shipping

Unless otherwise agreed, customers are responsible for reasonable return shipping costs associated solely with a voluntary change-of-mind return.

We recommend using an appropriate trackable delivery method.

antiquesandchic.shop is not responsible for a change-of-mind return that cannot reasonably be verified as having been sent or delivered to the designated return location.

This section does not apply where the customer is entitled to recover reasonable return costs under Australian Consumer Law because the product is faulty or otherwise fails to comply with statutory consumer guarantees.

Damaged, Defective or Incorrect Products

Customers should contact us as soon as reasonably possible if an order arrives:

  • Damaged;
  • Defective;
  • Unsafe;
  • Incorrect;
  • Missing significant components;
  • Materially different from its description; or
  • Otherwise not compliant with applicable consumer guarantees.

Please contact:

info@antiquesandchic.shop

and provide the order number and a description of the problem.

Photographs or other reasonable evidence may be requested where this assists us in assessing the issue.

Any request for photographs or assessment information is intended to help investigate the claim and does not remove a customer's statutory rights.

Australian Consumer Guarantees

Goods sold to Australian consumers come with statutory guarantees relating to matters such as acceptable quality, fitness for purpose and conformity with descriptions or representations.

These rights apply automatically and cannot be removed by a store's terms or refund policy.

A product problem may constitute a major failure where, for example, the product is unsafe, substantially different from its description, has a serious defect that would have prevented a reasonable consumer from purchasing it if known beforehand, or cannot be used for its normal purpose and cannot easily be fixed within a reasonable time.

Where a product has a major failure, eligible consumers may generally choose:

  • A refund; or
  • A replacement of the same type where reasonably available.

Additional compensation may also be available under applicable law for reasonably foreseeable loss or damage.

Minor Problems

Where a failure is minor rather than major, antiquesandchic.shop may be entitled to provide an appropriate remedy within a reasonable time.

Depending on the product and circumstances, this may include:

  • Repair;
  • Replacement;
  • Replacement component;
  • Other appropriate correction.

If a minor problem cannot be fixed or is not fixed within a reasonable time, further remedies may become available under Australian Consumer Law.

Assessment of Returned Products

Where permitted by law, we may reasonably inspect or assess a product before determining the appropriate remedy.

Assessment may be necessary to determine:

  • The nature of the problem;
  • Whether the product was damaged during delivery;
  • Whether a manufacturing defect exists;
  • Whether the problem resulted from misuse or accidental damage after delivery; and
  • Whether the issue represents a major or minor failure.

Any assessment process will be conducted consistently with mandatory consumer rights.

Items Normally Excluded From Voluntary Change-of-Mind Returns

For health, hygiene, safety or practical reasons, certain products may be excluded from our voluntary change-of-mind policy where applicable, including:

  • Personalised or custom-made products;
  • Products produced to a customer's individual specifications;
  • Perishable products;
  • Gift cards;
  • Sealed hygiene-sensitive products after the seal has been opened;
  • Products damaged after delivery through misuse; and
  • Products specifically identified before purchase as non-returnable for change-of-mind purposes where lawful.

These exclusions apply only to voluntary change-of-mind returns.

They do not remove any rights relating to faulty, unsafe, defective, damaged, misdescribed or otherwise non-compliant goods.

Sale and Promotional Products

Sale, clearance and promotional products remain protected by Australian Consumer Law.

A reduced price does not remove statutory consumer guarantees.

Where a discounted product is returned only because the customer changed their mind, the voluntary return conditions stated in this policy may apply.

Where a product was discounted because of a specific defect clearly disclosed before purchase, a customer may not be entitled to a remedy for that disclosed defect, although other undisclosed problems may still give rise to statutory rights.

Refund Processing

Once a return is received and approved for refund, antiquesandchic.shop will arrange the refund through the original payment method where reasonably practicable.

Customers will receive confirmation when the refund has been initiated.

Although we initiate approved refunds promptly, banks, card issuers and payment service providers may require additional processing time before funds appear in the customer's account.

We do not control those external banking processing periods.

Original Shipping Charges

Because antiquesandchic.shop provides free standard shipping on all orders, there is normally no standard outbound shipping charge to deduct from an eligible refund.

Exchanges and Replacements

Where an exchange or replacement is approved, availability depends on current inventory.

If an identical replacement is unavailable, we may discuss another appropriate solution with the customer, subject always to the customer's statutory rights.

Return Abuse and Fraud

We reserve the right to investigate suspected return fraud, including fabricated damage claims, substituted products or intentional misuse of the return process.

Nothing in this provision permits us to deny a genuine remedy that a consumer is legally entitled to receive.

How to Request a Return

To request a return, refund, replacement or remedy, contact:

info@antiquesandchic.shop

Please include the order number and sufficient details about the request.

Do not return products to an unconfirmed address. Return instructions will be provided when necessary.

Statutory Rights Prevail

Nothing in this Return and Refund Policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law.

If this voluntary policy provides less protection than mandatory Australian law in a particular situation, the mandatory legal protection applies.
